In compliance with the provisions of the Federal Law on the Protection of Personal Data in Possession of Private Parties (the "Law"), we wish to inform you that GenZ Protect, S. de R.L. de C.V., located within the Mexican Republic, is part of the GenZ Group.

You are hereby informed that, for the Mexican Republic, this is the Privacy Notice of GenZ Protect, S. de R.L. de C.V. ("GENZ PROTECT"), which regulates and validates all operations, services and data collection, and everything detailed below, and the trademarks belonging to GENZ PROTECT (the "Notice"), and which is effective as of February 1, 2025 via GENZ PROTECT’s website (the "Site"). Please read our Notice carefully so that you can fully understand how we collect, use, publish, protect and process the personal information of the data owners and/or data users (the "Owner").

The processing of the Owner's personal data will be carried out in accordance with this Notice, so from this moment onward it is understood that the Owner grants his consent for such processing.

This document is an integral part of the general Terms and Conditions of GENZ PROTECT, for which reason it is suggested that you review and read it carefully. By accepting the Terms and Conditions ("TOS") at the time of registration, the Owner accepts the policies contained herein, being:

The Notice Describes

All the information that GENZ PROTECT collects about the Owner,
How we process, collect, store and share that information, and
The privacy options we offer to the Owner to respect your rights.

This Notice applies to information we collect when you use our sites, our mobile applications or web Apps owned by our business partners through which GENZ PROTECT offers its services (in this case an "APP" that GENZ PROTECT has for downloading on the Android and/or iOS operating system) and others among our online products and services that we offer from time to time (the "Services"), and generally when you interact with us in any way. This Notice is an agreement between us and an Owner that uses our Site and/or Services.

The Owner is hereby informed that, as a result of the amendments to the Commercial Code in force and applicable in the United Mexican States, electronic signatures will be valid and considered by GENZ PROTECT as if they had been signed physically and/or in the presence of GENZ PROTECT, and for this reason upon acceptance of the TOS of the Notice and/or the APP, these will be considered as a means of approval by the Owner and as if such were a handwritten signature.

RIGHTS OF ACCESS, REMOVAL AND RECTIFICATION OF PERSONAL INFORMATION

The Owner has recognized and may exercise the rights to know, access, withdraw and update their Personal Information, including their e-mail address, as well as to oppose the processing of the same and to be informed of the transfers carried out, all in accordance with the provisions of the applicable regulations. To this end, the Owner guarantees and is responsible, in any case, for the veracity, accuracy, validity and authenticity of the personal information provided, and undertakes to keep it duly updated.

Confidential information may include and contain, but is not limited to, (i) full name, (ii) age, (iii) address, (iv) e-mail address, (v) occupation and/or (vi) other information that will be detailed below, which may be requested within the Site (the "Personal Information").

Once registered, the Owner may review and change the Personal Information that you have submitted to us during the registration process including:

Pseudonym and email address. Notwithstanding any changes you make, GENZ PROTECT will retain the above Personal Information for security and control purposes.
Registration information. Such as: company, address, city, region, zip code, primary phone number, secondary phone number, fax number, email, etc.

GENZ PROTECT reserves the right to modify the provisions of the Notice at any time it deems necessary. If this occurs, and in the event that the changes affect the Personal Information provided to us by the Owner by this means, we will notify you by modifying the effective date of the Notice through the Site, and/or by communicating with the Owner by email so that the Owner can make a final decision regarding whether or not to accept that their personal information be used in that way.

In the event that the Owner does not accept such, the legal-contractual relationship will be dissolved and his/her Personal Information will not be used in any way other than that which was informed at the time of collection. We encourage you to review this Notice each time you use our Services and/or the Site.

Similarly, in case of any doubt in this regard, the Owner can contact GENZ PROTECT to stay informed about our information practices and the ways in which they can protect their privacy. For more information about the confidentiality of your Personal Information, please contact us by email.

Information Provided by the Owner

This Notice applies to all information and data collected by GENZ PROTECT through its website, domains and/or authorized third parties (the "Processors"), which may be agents, promoters and/or any legally accredited person or company with which GENZ PROTECT enters into commercial contracts in which the participation of those as Processors is clearly indicated, and/or enters into agreements for the reliable submission of data for the purposes described in In the third section of this Notice. The Processors are obliged at all times to adhere to and observe this Notice. Data collected through public networks and/or Sites that do not have a legal and/or commercial relationship with GENZ PROTECT are not protected.

The Notice is intended to detail the practices related to the collection of data on the Site, as well as the type of information that is collected from visits to the Site and the data that the Owner provides voluntarily, including the treatment given to that information, the security standards that imply its protection in terms of compliance with applicable laws, the purposes of its use, and the instruments that the Owner can exercise for access to—or rectification, cancellation or opposition of— their collected data.

- GENZ PROTECT collects from the Owner Personal Data that proves their identity, such as:

- Name, address, date of birth, gender, nationality, official identification number, email, telephone, demographic data, among other similar data.

- GENZ PROTECT, being a company that has a domain and Internet Site, may use a variety of technologies that automatically or passively collect information when visiting and/or interacting with the content of this Site, which can be defined as the usage information,

- The Owner freely and voluntarily consents to the transfer and/or processing of his/her Personal Data to authorized third parties when registering his/her information through the Site.

- Any information collected from visits to the Site and/or that is voluntarily provided by the Owner through the registration forms on the Site that contains personally identifiable information, will be covered by this Notice regardless of the main purpose of the intercommunication, and in the case of any communication, material or any data that does not include personally identifiable information, such shall be managed in accordance with the provisions of the TOS. In the specific case of intercommunications containing sensitive data, the party responsible and/or its Processors will limit the period of processing of this information to a minimum necessary only for legitimate purposes and in accordance with the activities and purposes of GENZ PROTECT.

- GENZ PROTECT may collect this data through forms dedicated to the submission of information on the Site, and when the Owner deems it appropriate, it may voluntarily register its information and data necessary when the Owner intends to have direct contact with GENZ PROTECT for the purpose corresponding to the Owner's request, which may include but is not limited to the advice, administration, organization, operation, promotion and/or representation of events for the development, entertainment or recreation of the general public, among others, that GENZ PROTECT is authorized to provide in accordance with the purpose of its constitution.

The types of Personal Information we may collect include, but are not limited to, the following:

● Basic personal data such as your name, username, gender, date of birth, email address, home address, government identification number, cell phone number, and/or photographs;

● Messages and information from interactive forums, such as posts in group discussions, messages to other GENZ PROTECT users, and other data related to activities and events;

● Other reference data, such as your occupation, personal URL, instant messaging user, social media user, employment history, and other interests you provide; and

● Information about the Owner provided by other GENZ PROTECT members, such as trustworthiness ratings, contacts with friends, public referrals, and other relationships and communications with other GENZ PROTECT members.

Information Collected Automatically.

When the Owner accesses the Site or uses the Services, GENZ PROTECT may also collect certain personal information about the Owner automatically. This could include, but is not limited, to:

● Location: GENZ PROTECT may collect data about the Owner's location whenever the Owner accesses the GENZ PROTECT Site, uses its Services, or uses any GENZ PROTECT mobile application. For more information, please visit the settings section of your web browser or mobile device; and

● Data Collected by Cookies and Other Tracking Technologies: GENZ PROTECT may collect information automatically through the use of Cookies, web beacons, and other web tracking technologies. This could be used by GENZ PROTECT, among other things, to improve our service, monitor user activity, count visits, learn about the use and effectiveness of GENZ PROTECT's advertising campaigns and whether any action has been taken accordingly.

Other Sources of Information

GENZ PROTECT may obtain personal information from other sources and combine it with information we collect from our Services. For example, if the Owner registers or logs into GENZ PROTECT through their account on a social network, we will have access to certain information from that site, such as name, profile picture, contacts and other account data, as such may be in accordance with the authorization procedures of that social network.

Some of this information may be shared with other Owners. For example, they may be able to see your contacts who are also GENZ PROTECT users. GENZ PROTECT will not collect any personal information other than that provided to us by such social media platforms. Please note that such platforms are governed by their own terms and conditions and privacy policies and not ours, so we encourage you to review them regularly to be more informed about the practices of those companies, as well as to learn more about how to handle your preferences for the sharing of personal data.

- Use of Information.

We use this personal data for the purposes described in this Notice or as otherwise disclosed to you in connection with our Services. GENZ PROTECT may use the Owner’s Personal Information including, but not limited to, for the following purposes:

● To manage and improve our Services;

● Protect the Owner's security and provide our data verification service;

● Respond to your comments, questions, and requests, and provide customer service;

● Monitor and analyze trends, usage, and activities related to our Services;

● Personalize the Services. This includes offering content or applications related to the Owner's profile or your interests;

● Combine this data with other data obtained from third parties to understand your needs and provide you with the best service; and

● To improve our commercial initiatives and analyse the pages visited and searches made by users, in order to improve our offer of content and articles, and to personalize such content, its presentation and services.

Transfer of Personal Data Abroad

GENZ PROTECT may store the Owner's personal data in the United States of America and other countries, where the Owner may have fewer legal rights as provided by applicable local laws. However, regardless of where we store your data, it will be processed as set out in this Notice. GENZ PROTECT will ensure the security of Personal Information, and we will only transmit it to jurisdictions that have levels of protection at least similar to those of our applicable jurisdiction.

GENZ PROTECT also abides by certain privacy principles regarding the notice, choice, transfer, security, data integrity, access, and execution of our users' personal data. Therefore, we are governed by the essence of the following principles:

GENZ PROTECT is obliged to provide our Owners with basic information regarding the processing of their Personal Information (e.g. type of data collected, the purpose of the processing).

● Election: Owners whose personal data are processed by GENZ PROTECT may object to whether the data is communicated to a third party or used for a purpose other than that collected. GENZ PROTECT will ask for their express consent before communicating their data to an authorized third party, usually through a Click in a box of "I do" or similar means.

● Safety: The collection, processing, maintenance and use of the personal data of our Owners will be carried out under appropriate security measures, taking into account factors such as the nature of such personal data.

● Limitation of purpose for processing: The Personal Information collected must be limited to the relevant purpose for the processing of the same.

● Access: The Owners shall have the right of access to the processing of their Personal Information.

● Transfer Liability: Any subsequent transfer or communication to another responsible party or Processor may only be for our specific and limited purposes, taking into account this Notice.

● Responsibility: Our authorized third parties must have mechanisms in place to ensure compliance with security measures with respect to the personal data of our Owners, to at least the same extent as those used by us.

Information Sharing

GENZ PROTECT will not share the Owner's Personal Information except with authorized third parties, except in the cases described below where the Owner is cognizant and aware and/or as otherwise established in this Notice:

● With your consent, i.e., if we notify you through our Services and/or within the Site that the information you provide to us will be shared in a certain way and that the Owner agrees to provide such information;

● With search engines to be able to access the content that the Owner provides in discussion forums or in the public profile;

● In connection with, or during the negotiation, merger, sale of assets, financing, or acquisition of, all or a portion of our business by another company;

● When GENZ PROTECT believes disclosure is necessary to comply with applicable laws and regulations, legal process, requests and/or judicial notices or through governmental requests; and

● To enforce our agreements, policies, and terms of use; to protect the security or integrity of our Service and/or the Site; or to protect GENZ PROTECT, our business partners, our Owner or the public, from illegal activities and other harms.

We may also share aggregated, anonymous, or non-identifiable information that cannot be used to identify you in any way.

Confidentiality of Information

Once the Owner has submitted his/her information within the Site, GENZ PROTECT may not sell, lease or share the Personal Information with a third party, except with those business partners that it may have, or in accordance with the ways established in this Notice. Notwithstanding the foregoing, the Owner expressly and tacitly consents to GENZ PROTECT transferring all or part of the Personal Information to any of the companies controlled, controlling, and/or linked to, GENZ PROTECT in any capacity and at the time, in the form, and under the conditions that it deems appropriate. GENZ PROTECT will do everything in its power to protect the privacy of Personal Information. It may happen that, by virtue of court orders or legal regulations, GENZ PROTECT is obliged to disclose information to authorities or third parties under certain circumstances, or in cases that third parties intercept or access certain information or data transmissions, in which case GENZ PROTECT will not be responsible for the information that is disclosed.

Minors

The Owner at this time is notified and aware that both the Service that GENZ PROTECT provides and the Site are only available to those persons who have legal capacity to contract and bind themselves in any legal situation before any authority; that is, both the Service and the Site are only for those users who are 18 years of age or older. Therefore, those who do not comply with this condition must refrain from providing personal information to be included in our databases. However, they can do so through parents or guardians.

Web Beacons

A Web Beacon is an electronic image, also called a single-pixel (1 x 1) or transparent pixel, which is placed in the code of a Web page. A Web Beacon has similar purposes to Cookies. Additionally, a Web Beacon is used to measure patterns of user traffic from one page to another in order to maximize how traffic flows through the Web. The Owner and the visitor to the GENZ PROTECT Site are aware of and agree that GENZ PROTECT may use a tracking system through the use of Web Beacons.

Spam

GENZ PROTECT and the Owner do not accept conduct considered "spamming", whether in opinions, questions, answers and/or the unsolicited sending of emails. The indiscriminate sending of messages of any nature between users of GENZ PROTECT is absolutely prohibited.

GENZ PROTECT may suspend or permanently disqualify those Owners who violate this policy.

Third-Party Dissemination Tools

GENZ PROTECT may offer features for sharing the Owner’s information on social media or other tools integrated into our Services, which allow you to share the actions you take on them, with other means, and vice versa. The use of such features allows certain information to be shared with others and the public, depending on the settings you select with the third parties that provide such dissemination feature. For more information about the purpose and scope of data collection and processing in connection with social media sharing features, please visit the privacy policies of the third parties that provide such features to you. Please note that when the Owner uses them, the Owner will be subject to their respective privacy policies.

External Web Links

From time to time and at GENZ PROTECT's discretion, GENZ PROTECT may include or offer third-party products or services as part of our Services. These third parties may have privacy policies separate from GENZ PROTECT. Accordingly, GENZ PROTECT assumes no responsibility for the actions of these third parties, or for how they collect, use, or share your data.

Order of Competent Authorities - Legal Requirements

GENZ PROTECT cooperates with competent authorities and other third parties to ensure compliance with laws, e.g. on data protection in information, protection of industrial and intellectual property rights, fraud prevention and other matters.

GENZ PROTECT may disclose the Owner's Personal Information upon request from the competent judicial or governmental authorities for the purposes of investigations conducted by them, even if there is no executive or judicial order or subpoena, or for example (and without limitation in this case) when it comes to criminal or fraud investigations or those related to computer piracy or copyright infringement. In such situations, GENZ PROTECT will cooperate with the competent authorities in order to safeguard the integrity and safety of the community and that of the Owner and/or its users.

GENZ PROTECT may (and the Owner expressly and tacitly authorizes it) communicate any Personal Information about its users in order to comply with applicable regulations and cooperate with the competent authorities to the extent that we deem it necessary and appropriate in relation to any investigation of an illicit or fraud, infringement of industrial or intellectual property rights, or other activity that is illegal or that may expose GENZ PROTECT or its users to any legal liability. In addition, GENZ PROTECT may (and the Owner expressly and tacitly authorizes) communicate its full name, pseudonym, address, city, region, zip code, country, telephone number, email address, etc., to participants in the GENZ PROTECT intellectual property protection program in the manner that, in GENZ PROTECT's discretion, it deems necessary or appropriate in connection with the investigation of fraud, infringement of industrial or intellectual property rights, piracy, or any other illegal activity. This right shall be exercised by GENZ PROTECT in order to cooperate with the compliance and execution of the law, regardless of whether there is a judicial or administrative order to that effect.

In addition, GENZ PROTECT reserves the right (and the Owner expressly and tacitly authorizes it) to communicate information about its users to other users, entities or third parties when there are sufficient grounds to consider that the activity of a user is suspected of attempting to commit or committing a crime or attempting to harm other people. This right shall be used by GENZ PROTECT in its sole discretion when it deems it appropriate or necessary to maintain the integrity and safety of the community and its users, to enforce the TOS and other policies of the Site, and to cooperate with the enforcement and enforcement of the law. This right will be exercised by GENZ PROTECT regardless of whether there is a judicial or administrative order to that effect.

Security - Information Storage

GENZ PROTECT is required to comply with all applicable regulations regarding security measures applicable to Personal Information. In addition, GENZ PROTECT uses industry standards to protect the confidentiality of your Personal Information, including, but not limited to, firewalls and Secure Socket Layers ("SSL"). GENZ PROTECT considers its users' data as an asset that must be protected from any loss or unauthorized access. GENZ PROTECT employs various security techniques to protect such data from unauthorized access by users inside or outside our company. However, it is necessary to keep in mind that perfect security does not exist on the Internet.

Therefore, GENZ PROTECT is not responsible for illegal interceptions or breaches of its systems or databases by unauthorized persons. GENZ PROTECT is also not responsible for the improper use of the information obtained by these means.

Data Protection Officer

The area in charge of GENZ PROTECT's Data Protection will be the employees that GENZ PROTECT may appoint, whom you can contact in the manner detailed below:

The area in charge of requests, queries and claims regarding personal data
The area in charge of dealing with the requests, queries and claims of the Owners to exercise their rights to know, update, rectify and delete their data and revoke their authorization is the Customer Service area of GENZ PROTECT
Means to exercise the rights of access, withdrawal and rectification of personal data

To make any query, claim and/or request regarding your personal data, you can do so by entering the section indicated on the GENZ PROTECT website, contacting us via the email datospersonales@genzprotect.com, or by regular mail at the following address: Av. Miguel Hidalgo 112-39, Bosque de los Encinos, Col. Juárez 52743, State of México.

GENZ PROTECT will respond to the request within the stipulated period of 72 hours, and if it is not possible to respond to the query within said period, we will notify you in a timely manner, stating the reasons for the delay and indicating the date on which it will be attended.

Please note that the request for removal or deletion will not proceed where there is a contractual or legal duty to keep it in our database.

Protection of Our Visitors' Data

GENZ PROTECT takes reasonable steps to protect your data from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction.

Most web browsers are set to accept cookies by default. However, you can set your browser to delete or reject browser cookies. All browsers are different; therefore, you should check your browser's help menu to modify your cookie settings. The Owner should be aware that our Services may not function properly if the Owner’s browser does not accept cookies.

Data Validity Period

The Owner's Personal Information will remain in our database for the period necessary to fulfill the uses and purposes described in the Notice or in the TOS.

Advertising

From time to time, GENZ PROTECT may offer the opportunity to receive marketing communications from GENZ PROTECT, business partners, or their authorized third parties, through invitations on our Site or otherwise, where you may or may not expressly consent. To stop receiving such communications, you can follow the instructions in the emails you receive.
